Owner

Simon Tolbert

Simon is the managing attorney of Mountain States Energy Attorney & Advisors, PLLC d/b/a Tolbert Law Office, PLLC (“MSEA”). Originally started as a natural resources boutique law firm, the firm has expanded to include related general areas of law including:  trust & estates, contracts, real property, and tort law. This approach allows the firm to bring innovative solutions to its clients facing a broader range of legal issues.  

Simon grew up in Texas and got into the oil and gas business coincidentally after running into an old friend from high school who worked for his uncle who worked as a crew manager for a rig.  The next day they started together working as a landmen running title and negotiating leases in the Barnett Shale. Simon learned that if you have the right work ethic, organizational skills, and attention to detail anyone without any prior experience can likely have a long-term career in the oil and gas industry. Simon coupled his landman career with his service as a logistics officer in the United States Marine Corps Reserves. Simon deployment to Iraq in 2008 as a logistics officer for an infantry battalion, and as an unintended result broadened his education for practicing law to solve potential conflicts in the courtroom in a similar way to solve some of the complicated conflicts in a theater of war. Thereafter, he began using his law license in Denver working for a law firm based out of Houston and later another out of Salt Lake City. The decision to start a law firm was simple, “to provide the best representation for his clients.” Simon’s favorite axiom that he repeatedly reminds his clients is that “an ounce of prevention is worth a pound of cure,” especially in regard to legal proceedings.

During his few hours of free time, he enjoys going out to restaurants with his wife Amy and baby boy Jude, riding his Peloton stationary bike, and watching the Denver Nuggets.

Joe Pope

Joe Pope is a commercial transaction expert, skilled in negotiating and drafting contracts, and, more importantly closing the transaction. He has gained extensive experience in all phases of the oil and gas exploration and production business, including lease acquisitions, operations, pooling and unitization, operating and trade agreements. Formerly a member of the Rocky Mountain Mineral Law Foundation’s Revision Committee, he was instrumental drafting the 1994 revision of the Form 2 Federal Exploratory Divided Unit Operating Agreement.

Joe’s extensive experience drilling hundreds of exploratory and development wells provides critical insights into the regulatory and agency issues involved, including presentations to and representations before regulatory bodies, designing and negotiating solutions and settlements, and obtaining permits and approvals for diverse projects from State and Federal agencies throughout the Western United States. These agencies include the Bureaus of Land Management in Wyoming, Colorado, Montana, Utah, New Mexico and Nevada; State oil and gas commission and land offices in Arkansas, Texas and Wyoming; and several Indian Tribes.

Joe joined MSEA in early 2019 in an ‘of counsel’ advisory basis, previously working as an oil and gas title attorney, inhouse landman for ExxonMobil, and serves as the Vice President of Land and Legal for an exploration company with operations in North Dakota.

PARALEGAL

Claudia Key

Claudia is a paralegal with MSEA. She grew up in Germany where she received her formal education, and moved to America when she was eighteen years old. She began working as a trust and estates paralegal in 2007, preparing detail-oriented estate plans and worked as the general paralegal for an estate planning law firm. Claudia then worked as a paralegal for the Denver County Public Administrator’s Office handling a multitude of issues with administration of trust and estate proceedings. Thereafter, she began working with MSEA and uses her experience with trust and estates to help the firm prepare estate plans and administrative proceedings, and uses her organization skills and attention to detail gained from her formal education in helping the firm prepare title opinions.

Andy Long

Andy is a landman with MSEA. Andy grew up in the Oregon timber country and is an avid Oregon Ducks fan. He obtained his bachelor of science in geological sciences from the University of Oregon, Eugene. Thereafter, he obtained a business degree with an emphasis on land and resource management from Western Colorado State University, and began his career working as a field landman in the Cheyenne working the Niobrara, then was sent to Williston to work the Bakken, then to Zanesville, Ohio to work the Marcellus. He moved to Denver in 2013 and began working for a large oil and gas lease broker, and later as an inhouse landman at a large mineral buying company reviewing title, lease records, and title opinions.
